These Terms of Service (“Terms”) govern your access to and use of thebizbud.com (the “Site”) and any related services BizBud offers through the Site. By visiting the Site, contacting us through it, or engaging BizBud as your accounting or tax provider, you agree to these Terms. If you do not agree, please do not use the Site or our services.

Who we are

BizBud is an accounting firm that provides monthly bookkeeping, accounting, year-round proactive tax strategy, and related services specifically for content creators, influencers, and digital nomads. We are based in the United States and our services are designed for US-based tax and accounting compliance. We are not a registered investment adviser, broker-dealer, or law firm. Nothing on the Site constitutes legal advice, investment advice, or a recommendation to buy or sell any security.

What the Site is and is not

Thebizbud.com is an informational website for our firm. The blog posts, guides, calculators, and other content on the Site are general educational information about tax, accounting, and small-business topics. They are not tailored advice for your specific situation. Tax, accounting, and financial outcomes depend on facts and circumstances that the Site cannot know. Before acting on anything you read here, please consult with us or another qualified professional advisor.

Engagement of BizBud as your accounting or tax provider happens only through a separate signed engagement letter that defines the scope of work, the fees, and the responsibilities of both parties. Visiting the Site, downloading a guide, scheduling a consultation, or exchanging emails with us does not create an accountant-client relationship in itself.

Account information and content you submit

When you contact us through the Site or use any client portal we provide, you agree to give us accurate, current, and complete information, to keep that information updated, and to keep any login credentials confidential. You are responsible for activity that occurs under your account or login. If you believe your account has been accessed without your permission, contact us immediately.

You retain ownership of any information and documents you provide to us. By providing information through the Site, you grant BizBud the right to use that information for the purposes of responding to you, evaluating whether to engage with you, and (if we do engage) delivering services to you under your engagement letter.

Intellectual property

The Site, its content (including blog posts, articles, guides, calculators, graphics, logos, and design), and the BizBud name and trademarks are owned by BizBud or its licensors and are protected by US and international intellectual property laws. You may view and read Site content for your own personal, non-commercial use. You may share links to specific articles. You may not copy, republish, distribute, modify, or use Site content for commercial purposes without our written permission.

Engagement letters and professional services

Any professional services BizBud delivers are governed by a separate written engagement letter signed between you and BizBud. The engagement letter sets the scope of work, fees, payment terms, deliverables, timelines, and the responsibilities of both parties. If anything in the engagement letter conflicts with these Terms, the engagement letter controls for the specific engagement.

Tax filings, bookkeeping work, financial statements, and other deliverables we produce as part of an engagement are based on information you provide. The accuracy and completeness of those deliverables depends on the accuracy and completeness of the information you give us.

Fees, billing, and refunds

Fees for engagements are set in the engagement letter. We accept payment through ACH, credit card, and check.. Recurring monthly engagements are billed at the start of each service month unless the engagement letter says otherwise. Late payment may result in late fees and, in extended cases, suspension of services until the account is current.

Confidentiality

We treat all information you share with us as confidential and will not disclose it to third parties except as described in our Privacy Policy or as required by law. Internal Revenue Code Section 7216 specifically governs how we handle tax return information; we comply with it. You agree to treat any non-public BizBud information you receive (pricing, internal methodology, software, engagement-letter language) as confidential and not disclose it to third parties without our written consent.

Disclaimers and limitation of liability

The Site and Site content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or that the Site will be uninterrupted or error-free. We do our best to keep Site content accurate and current, but tax law, accounting standards, and regulations change frequently and we cannot guarantee that every piece of content reflects the most current rules at every moment.

To the maximum extent permitted by law, BizBud, its principals, employees, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages of any kind arising from your use of the Site or any reliance on Site content. For damages arising from a paid engagement with BizBud, the limitation of liability terms in that engagement letter govern.

Nothing in these Terms limits liability for fraud, willful misconduct, or any liability that cannot lawfully be limited under applicable professional standards or state law.

Third-party links and services

The Site may link to third-party websites, software, or services (for example, accounting software providers, payment processors, or industry resources). We do not control those third parties and are not responsible for their content, practices, or privacy policies. Using a third-party site or service is at your own risk and subject to that third party’s terms.

Termination

We may suspend or terminate your access to the Site or any client portal at any time, with or without notice, for any reason, including violation of these Terms, non-payment of fees, or behavior that is abusive toward our team. Termination of a paid engagement is governed by the engagement letter, not these Terms.

Governing law and dispute resolution

These Terms are governed by the laws of the State of  Tennessee, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in Tennessee, and you consent to the personal jurisdiction of those courts.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top. Continued use of the Site after an update means you accept the revised Terms. If you have an active engagement with us, material changes will be communicated by email.
